Terms of Service

BlokBlok (“BlokBlok”, “we”, “us”, “our”) is a community-curated catalogue and marketplace for Mega Bloks, Mega Construx, Mega, and Mattel Brick Shop building toys, operated from the United Kingdom. These Terms of Service (the “Terms”) are a binding agreement between you and BlokBlok governing your use of our website and services (the “Service”). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you don't agree, don't use BlokBlok.

Nothing in these Terms affects your statutory rights as a consumer that cannot be excluded or limited by law.

• User — anyone who uses the Service.
• Seller — a User who lists items for sale; Buyer — a User who buys or seeks to buy.
• Listing — an item a Seller offers via the Service.
• Content — anything you submit: listings, photos, messages, feedback, forum posts, and catalogue contributions.
• Contributions — corrections, new items, images, and other additions you make to the shared catalogue.

• You must be at least 13 years old to hold an account, and at least 18 to sell. If you're under 18, you confirm you have a parent or guardian's permission to use the Service.
• Provide accurate information and keep your login credentials secure. You're responsible for everything done under your account.
• One account per person. Don't impersonate others or create accounts to evade a suspension.
• Privileged actions by our administrators and moderators are logged for accountability.

BlokBlok provides a platform where Buyers and Sellers find each other. We are not a party to any sale, and any resulting contract is solely between Buyer and Seller.

• Payments happen off the platform. BlokBlok does not process, hold, escrow, or handle money. Buyers pay Sellers directly using a method the Seller accepts (e.g. PayPal, bank transfer, Wise).
• We don't pre-screen or verify Listings, and we don't guarantee the existence, quality, safety, legality, condition, or accuracy of any item, a Seller's right or ability to sell, or a Buyer's ability to pay.
• You deal with other Users at your own risk. We may offer optional dispute mediation as a goodwill feature, but we're under no obligation to mediate and are not responsible for outcomes.

• Only commit to a purchase you intend to complete, and pay promptly using the Seller's stated method.
• Communicate in good faith and resolve issues directly with the Seller first.
• Be cautious sharing personal or payment information, and never move a deal off-platform to avoid scrutiny.

• List only items you own and may lawfully sell, described honestly (condition, completeness, photos), and fulfil orders you accept.
• Prohibited items: counterfeit, replica, or unauthorised items; recalled or unsafe goods; stolen goods; items that infringe intellectual property; and anything illegal to sell in the relevant jurisdiction.
• You are solely responsible for your own tax, customs, and regulatory obligations.
• Business / trader Sellers: if you sell in the course of a business, you are a “trader” and must comply with applicable consumer law — including, in the UK, the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 (such as the 14-day cancellation right for distance sales). BlokBlok does not determine, verify, or police whether you are a trader, and assumes no responsibility for your compliance.
• Don't use the Service to solicit off-platform deals designed to defraud, or to evade these Terms.

Feedback must be honest and based on a genuine transaction. Don't post false, retaliatory, or manipulated feedback, trade or buy feedback, or use it to threaten or extort another User. We may remove feedback that breaches these rules.

You keep ownership of your Content. By submitting it, you grant BlokBlok a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, adapt (e.g. resize images), publish, and display it for the purpose of operating, improving, and promoting the Service. Contributions may be incorporated into the public catalogue and may remain there even after you close your account.

You warrant that you own or have the rights to all Content you submit, and that it doesn't infringe anyone's rights or break the law. We may review, moderate, edit, hide, or remove Content at our discretion, and we use automated tools to screen text and images; flagged material is reviewed by a person before action where it matters. We are not obliged to store or back up your Content.

You must not:

• break the law or infringe others' rights;
• post illegal, hateful, harassing, defamatory, or sexually explicit content;
• spam, scam, phish, impersonate, or send unsolicited commercial messages;
• scrape or bulk-extract the catalogue, circumvent rate limits, probe or attack the Service's security, or interfere with its operation;
• misuse direct messages or feedback to harass, defraud, or extort.

The BlokBlok name, branding, software, and original content are owned by us or our licensors. “Mega Bloks”, “Mega Construx”, “MEGA”, “Mattel”, and related names are trademarks of their respective owners. BlokBlok is an independent, unofficial project and is not affiliated with, endorsed, or sponsored by Mattel, Inc., Mega Brands, or any franchise rights-holder. Catalogue data is community-curated from public sources with attribution (see Sources).

BlokBlok is a new and evolving service. We may add, change, suspend, or discontinue features at any time, and we don't guarantee uninterrupted or error-free availability. We may also update these Terms; for significant changes we'll update the date above and give reasonable notice. Continuing to use the Service after changes take effect means you accept them.

You may close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk for other Users or for us, or where required by law. On termination your right to use the Service ends; some records (such as completed-order and feedback history, and catalogue Contributions) may be retained as described in our Privacy Policy.

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted or error-free, or that catalogue data, prices, or price-history information are complete or accurate.

To the fullest extent permitted by law, BlokBlok is not liable for any loss or damage arising from: transactions or dealings between Users; off-platform payments; the acts or omissions of any User; reliance on catalogue data; or your use of (or inability to use) the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law. If you are a consumer, your statutory rights are unaffected.

If you are a business User, you agree to indemnify BlokBlok against reasonable losses, damages, and costs we incur arising from your breach of these Terms, your Content, or your transactions with other Users. This clause does not apply to the extent it would be unenforceable or unfair under consumer-protection law.

The Service may link to or rely on third-party sites and tools we don't control (including the off-platform payment methods Sellers use). We're not responsible for their content, policies, or practices; your use of them is at your own risk and subject to their terms.

• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us on this subject.
• Severability. If any provision is held unenforceable, the rest remain in force.
• No waiver. Not enforcing a term isn't a waiver of it.
• Assignment. We may assign these Terms (e.g. in a reorganisation); you may not assign yours without our consent.
• No agency. Nothing here creates a partnership, agency, or employment relationship.
• Notices. We may give notice via the Service or the email on your account; reach us at hey@blokblok.io.
• Events beyond our control. We're not liable for failures caused by events outside our reasonable control.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or the EU, you benefit from any mandatory protections of your home jurisdiction and may be able to bring proceedings there.
